General terms of sales

All orders implies on the part of the buyer, who has acknowledged after reading it, acceptance of those conditions.

In the event that an express agreement derogates from certain clauses of these terms and conditions, other provisions shall remain applicable between the parties.

Price and rates:

Our prices include all taxes and are invoiced based on the rates of the company the day of the shipping, and according to the shipping and payable fees on that date.

For exportation, invoices exempted from TVA will be made out taxeless. All payments are to be made to the order of La Truffe du Ventoux.

Any non-payement to an invoice by the agreed due date will result with a formal notice and without prejudice to any damages.

La Truffe du Ventoux (Les Frères Jaumard) reserves the right to adjust its prices rates. This modification will take effect one month after the publications of the newer rates.

Our Products
Our product offers and prices are available while stock last.
The indicated weight of the truffles in terrine is the weight of the day of the packaging, this cooking method does not guarantee a net weight once drained. The weight of the fresh truffles mentioned is the weight calculated the day of packaging.However, the buyer shall be informed that being a fresh mushroom, the truffle may experience a weight loss up to 4% per day of transit. The seal of the carrier shall be proof of the removal date.

Delivery
We deliver and ship to most European countries as well as some international destinations. Fresh truffles need to be shipped express (24h) in order to guarantee their freshness. These express packages are sent and followed by TNT or Geodis. Concerning derivative products, we are shipping them by Colissimo (2 to 5 days)
The client must be present at the delivery address when the carrier passes. In this case, two options are available:
-Indicate the address where it is certain someone can receive the package (housekeeper, friend, neighbor, workplace …)
It is important to give as much information as possible
-If the carrier shows up at the delivery address and nobody can receive the package, then the carrier will contact you by phone to schedule a new delivery time or a new address, pick up spot nearby to deliver package to.
Express deliveries are made from Tuesday to Friday. Possibility up to Saturday morning, All orders made by 2pm between Monday and Thursday will arrive the following day (for instance: an order made on Monday before 2pm will arrive Tuesday)

Delivery methods for private clients
-Express:24E (delivery before 1pm or beginning of afternoon in rural area -12am Express: 25E (delivery before 12am in France) -1pm Express:30E (delivery before 10am in France)
-France normal:9.96E (2 to 3 days) with Colissimo -Europe express:39.67E (1 to 2 days according to the country)
Europe normal: 17.96E (3 to 5 days according to the country) with Colissimo -Other countries express:50.31E (1 to 3 days according to the country)
These delivery schedules and times agreed by the company may be extended due to any unexpected events (social movements, traffic disruption, etc…) Therefore we commit ourselves to keep the customer informed the day of the delivery of all changes in order to re-schedule a possible delivery the same day or following day.

Payment methods
The payement for your online purchases is made by debit/credit card (CB,Visa,Mastercard, all online payments are secure)
All other orders made by other methods, payments can be made by:

Your order will be processed only once payment ha been received, delays are established according to they of check reception.
Bank money transfer: Ask for our bank identity (RIB)
All products will remain the property of La Truffe du Ventoux until full price payment.
In the event of a late payement in commercial transactions, the law of March 22nd , 2012, relating to the simplification of the law establishes, as of January 1st, 2013, an inclusive compensation for collection costs.
The creditor may claim, in addition to late penalties due as of right, a compensation of an amount fixed by decree at 40E

Right of withdrawal
You have the right of withdrawal of 14 days from the day of the reception, provided by law, in order to return any products without having to justify a reason. Return costs will be charged, only price of the product(s) will be refunded.Products must be returned in their original condition and attached by copy of the invoice.
All items retuned incomplete, damaged by the customer are not accepted. The right of withdrawal does not apply to fresh truffles.

Defect

If a product would happen to show defects, we commit ourselves to replace it. The return fees can be covered upon simple request. These fees may, in any case, not exceed the fees of initially invoiced shipping costs. Simply contact us within 72 hours and return the package to us attached to a registered letter with acknowledgment of reception.

Liability

All offered products comply with current French legislation. La Truffe du Ventoux will not be held liable in the event of non-compliance with the legislation of the country where the products are delivered to. It is your responsibility to check with local authorities the possibilities to import and/or use the products you are planning to order. We invite you to refer to the description of each product to know its precise characteristics. Do not hesitate to contact us if you have any doubts or if you wish further information.

Protection

Elements contained on this site, in particular the texts, illustrations and photographs can not be the object of any use, modification, alteration, partial or total reproduction and more generally without the express agreement of the company La Truffe du Ventoux.

Litigation

This agreement is subject to the French law. The language of this present agreement is French. Any dispute will be under the exclusive juridiction of the Commercial Court, which has sole jurisdiction, regardless of the place of shipping.
